Making a Statutory Will

A person who lacks the necessary capacity to manage their financial affairs may also lack the capacity to update their Will, undertake tax planning or give gifts.

Importantly, though, a person has lost mental capacity in regards to managing their finances does not automatically mean they are incapable of making a will. If you are unsure of the legal status of an individual in regards to this matter, please contact us for advice.

Our specialist Court of Protection solicitors can also assist with applications to the Court of Protection for a Statutory Will or a change to one.
